ArtCap qualifies prospective collectors and may, where appropriate, facilitate a direct introduction to an artist, studio or estate. ArtCap is not an online gallery, does not sell the artwork, does not receive the collector’s purchase funds and charges the collector no introduction fee. An introduction does not oblige any party to proceed.

Website content, including ArtCap Perspectives, is provided for general cultural and market context. It is not financial, investment, tax, valuation or legal advice. We do not promise that any artwork will retain or increase its value, provide a return, hedge inflation or be capable of resale at a particular time or price.

If an acquisition follows an introduction, the agreement and payment are directly between the collector and the artist, studio, estate or authorised seller. Collectors should satisfy themselves about authority to sell, authenticity, provenance, condition, price, taxes, delivery, insurance, copyright and any other material terms, taking independent professional advice where appropriate.

We take reasonable care over the website, but information may change and may not always be complete or current. References to artists, works, access, commissions, future projects or availability are not offers or guarantees. The artist, studio or estate decides whether and on what terms any conversation or opportunity proceeds.

You must not misuse the website, attempt unauthorised access, introduce malicious code, interfere with its operation or use its content unlawfully. We may restrict access where reasonably necessary for security or protection of our rights.

Unless stated otherwise, the website’s design, copy, branding and original materials belong to or are licensed to ARTCAP LTD. They may not be reproduced commercially without written permission. Copyright in artworks and third-party materials remains with the relevant rights holder.

Links to third-party services are provided for convenience and do not make ArtCap responsible for their content or privacy practices. Email, telephone and WhatsApp are not guaranteed to be continuously available or completely secure; do not send payment-card details or passwords through ordinary messages.

Nothing in these terms excludes liability that cannot lawfully be excluded. To the extent permitted by law, ArtCap is not responsible for losses arising solely from reliance on general website information, the availability of third-party services or decisions made independently between a collector and a seller.

These website terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction, subject to any mandatory rights that apply to a user in another part of the United Kingdom.
