ARTCAP LTD (company number 15347169) is the controller responsible for your personal information. Our registered office is 3rd Floor, 86–90 Paul Street, London, England, United Kingdom, EC2A 4NE. Our ICO registration update is currently pending and the registration number will be added when confirmed.

Information we may collect

We may collect your name, contact details, communication preferences, collecting interests, relevant experience, anticipated acquisition parameters and the contents of your correspondence with us. If a relationship develops, we may also retain meeting notes, records of introductions and information needed to manage that relationship.

Our website and hosting provider may process limited technical information needed for security and reliable delivery, such as IP address, browser type, device information and request logs.

Advertising measurement

If you accept marketing cookies, the Meta Pixel records visits to the website and whether the initial or completed private-access enquiry stage was reached. We use this information to measure and improve ArtCap advertising. Form entries such as your name, email address, telephone number, answers, budget range and message are not sent in Pixel events. Meta may process device, browser and network information as an independent provider. You can withdraw consent through Cookie choices on the website.

How we receive information

We receive information directly from you by telephone, email, WhatsApp, video meeting, in person or through a website enquiry. We may also receive information from a person who refers you to ArtCap, or from publicly available professional sources where it is reasonable and relevant to an enquiry.

Why we use it

  • To respond to enquiries and understand whether ArtCap can assist you.
  • To qualify potential introductions and arrange conversations with appropriate artists, studios or estates.
  • To maintain our professional relationships and records.
  • To operate, secure and improve the website.
  • To meet legal, regulatory, accounting and fraud-prevention obligations.
  • To send marketing only where the law permits it and you have not objected or withdrawn consent.

Depending on the circumstances, we rely on steps requested before entering an arrangement, our legitimate interests in operating ArtCap and managing genuine enquiries, consent, or compliance with a legal obligation.

Who we share information with

Where an introduction is appropriate, we may share relevant details with the artist, studio or estate after explaining the proposed introduction. We may also use trusted providers supporting email, communications, website hosting, professional advice and business administration. We do not sell personal information.

We may disclose information where required by law, regulation, court order or to protect legitimate legal rights.

International services

Some communications and technology providers, including WhatsApp and its associated Meta services, may process information outside the United Kingdom. Where this applies, we rely on the provider’s contractual and legal safeguards for international transfers.

How long we keep information

Initial enquiry records will normally be retained for up to 24 months after the last meaningful contact, unless a relationship develops or there is a legal or operational reason to retain them longer. Client, introduction and transaction-related records may be retained for longer periods where necessary for legal, accounting or dispute purposes. These periods will be reviewed before the final website launches.

Your rights
